Certainty regularly meet senior legal professionals to discuss the ongoing developments of the register . Kevin Martin, Chairman of Certainty and Andrew East, Chairman STEP UK Probate & Estates Committee recently expressed the following views…
5. Q. Do you think that un qualified will writers erode future private client relationships through the possibility of a new client coming to a solicitor to write a will and eventually use other services as opposed to an un qualified will writer going round to some ones house for £35 and loosing the future opportunity of a client relationship with a solicitor.
A: (Andrew) Well yes I think that obviously must be a danger. When we get someone through the door to write a will you are also looking to see if there are other areas, other services that we can help them with, which the will writer won’t necessarily be looking at because they do tend to be very narrowly focused on writing a will. But they’ll often, and certainly in the past, try to sell you enduring powers of attorney, lifetime storage and various other extras which would make the basic £35 end up costing you three or four hundred, which was one of the sharper practices of the worst of the unqualified will writers. But yes certainly I think everyone who goes to a will writer for his will is a lost client for a solicitor or STEP member.
