How do I write a new Will?

This is a letter the Certainty National Will Register has received from a member of the public.

While it is possible for a person to make a Will, this can lead to problems such as the Will not being valid.  A Will made without legal advice may mean that property will not pass as the deceased intended. It is far safer, and usually easier, to see a solicitor, who will find out how you want your assets to be dealt with and write a new will.  They will then advise as to the appropriate type of Will and other matters that you may wish to take into consideration. 

Your Will can be used as a means of leaving gifts of money or property to friends, relatives, charities, the Church and so forth, as a means of providing for the future upkeep of dependants, as a means of reducing liability to tax, and for giving instructions as to the disposal of your body. The majority of Wills are quite straight forward and are not therefore very expensive.  If, however your affairs are more complex then obviously your Will may be more expensive to prepare.  But this will be amply compensated for in terms of tax and other savings and in the peace of mind that it will bring to your executors. Good advice from a solicitor could save your estate from paying out thousands of pounds in unnecessary inheritance tax.

If your circumstances change, for example you get married, divorced or you have children, then you should ensure you contact a solicitor to write a new will so that you ensure your Will continues to provide for your dependants in the way that you would want it to. If your personal fortune increases, or you an inheritance or other large sum of money, you will need to ensure that your Will still deals with your estate in the most effective manner possible.
